Legalizing recreational use of pot in CO

What will happen now that recreational use of pot will be legal in Colorado? Please tell me cadets will not be permitted its use!

It's such a gateway drug - I just can't imagine how they will work with or around this new law.

Don't worry. We still can't use it per the UCMJ. Bummer :rolleyes:
 
Most likely it will end up as a Supreme Court case. State laws can't override Federal. It is currently a Federal law that you can't use it. So this ballot item will serve more as a test case of the existing Federal law.
 
Legalities aside, it is important to note that the majority of research shows that marijuana is not a "gateway " drug. The correlation is between high risk or addictive behavior and escalation of drug use. Those individuals whose overuse of any substance or activity-legal or illicit- becomes a focus or impacts their activities of daily living are much more likely to engage in progressively risky behavior. These types of "addictions" include tobacco, overeating, gambling as well as things you may not necessarily consider detrimental- again it is about the predilection for addiction rather than the qualities of THC. In addition, the previous poster is correct, we will unfortunately see a flurry of court filings and a long running battle, at great expense of time and money-especially when the reality is that individual entities can make thier own rules about what can and cannot be done on their premises.
 
Doesn't matter one bit what Colorado said on their recent election. As previously stated, Federal Law trumps State Law.

UCMJ, Article 112a:

“(a) Any person subject to this chapter who wrongfully uses, possesses, manufactures, distributes, imports into the customs territory of the United States, exports from the United States, or introduces into an installation, vessel, vehicle, or aircraft used by or under the control of the armed forces a substance described in subsection (b) shall be punished as a court-martial may direct.

(b) The substances referred to in subsection (a) are the following:

(1) opium, heroin, cocaine, amphetamine, lysergic acid diethylamide, methamphetamine, phencyclidine, barbituric acid, and marijuana, and any compound or derivative of any such substance.

(2) Any substance not specified in clause (1) that is listed on a schedule of controlled substances prescribed by the President for the purposes of this article.

(3) Any other substance not specified in clause (1) or contained on a list prescribed by the President under clause (2) that is listed in Schedules I through V of section 202 of the Controlled Substances Act ( 21 U.S.C. 812).”

That's just the FIRST one that would apply. There are others.

Just a note to MDAnderson: well sure, drinking a beer doesn't necessarily mean that one will end up a wino living under a bridge, cradling one's last few drops of MD2020. However, if one does not imbibe in marijuana EVER, it's pretty clear that one will also not be using meth, speed, cocaine, or heroin. In that regard, marijuana is indeed a gateway drug and I would put it to you that hard drug abusers almost always start with marijuana or other drugs easily obtained in the gas station parking lot.

This mother is very grateful that drug abuse was not an issue she had to deal with.
 
and furthermore, I might want to be a Colorado attorney, with a little FritoLay franchise operation on the side in the coming years. :)

Basically there a process to follow and they're following it to the letter.
 
even if it passes federal law which could take a long time, it will still have to go through regulatory processes. I'm assuming it has some health risks like smoking and will have to have proper lables and regulation. I'm sure the big tabacco companies are already prepped to handle this, but it will have to be regulated like alcohol and cigarettes (and Taxed heavily.) so maybe it will be there in 2016.

Funny how the states that like ban cigarette smoking in public places are the first to want to legalize pot.
 
That is all we need, another legalized drug. How does one determine if the fault of an accident is because a person had too high of a level of THC in their blood stream? Not like there is a breathalizer for that. On the other hand, THC has a long Half life, hence it is detectable out to 3-4 weeks. I do not know how many people are willing to go three weeks without operating a motor vehicle. Those are the issues I think that face us. It is not just a matter of legalize or not.

Yes these are the issues they are trying to work through now. Both the regulation and testing of this are huge. It will have all the restrictions of alcohol and I think some of smoking. I just don't know how they will get around the blood test on this one. And they're talking about taxing the hell out of this something like 25% on each transaction from growth to consumer.

As far as the UCMJ and employment in general I think any company will still fire/not hire you for use. Just because it may turn out in the end to be legal an employeer (including the US Gov) still has the right to say it will not hire someone if they smoke it. Will people fight that next? You bet and that's a whole different fight.

What bugs me is when people here talk about all the money they will save since law enforcement will not waste their time with this. I tell them it's just a switch of money. All this money saved will just move from law enforcement to regulation and enforcement.
 
Since we have a Supremacy Clause, Article 6 of the US Constitution if I am not mistaken, technically someone could smoke pot and be fine around local police in CO but could still be arrested by Federal agents since the federal ruling that Marijuana is illegal reigns supreme over a state ruling.

Additionally, I don't believe any study can really quantify the effect that marijuana has on the mental development of youth. 99% of the kids I know of that smoke weed are not 'top notch' kids to say the least. However, there is much to be said regarding the social aspect of smoking weed, which can take over someones entire life, thus affecting important things such as schooling and their health negatively.

I won't touch it even if legal but I still believe more people are killed ( one way or another) via alcohol.

However I think lack of ambition is a likely consequence. Video game manufacturers will have a whole new avenue of trippy visuals to add to games.
Smoking is smoking, it can't be good for you.

I am sure there will be the "a glass of red wine a day is good for you" crowd with pot too. It definately needs a new name.

I predict a bumper crop for marketing whizzes who can turn a phrase. One slight problem is it isn't as funny if you are not.........you know.

The right will think this is ploy from the left to manage the populous. It will a whole book burning ( ::thumbdown::) topic in the next election cycle.
It will be interesting to watch.
