Would a 2LT that is administratively discharged be required to pay back their USMA tuition? Where would I be able to find the regulation on this?
 
I think it will depend a lot on the conditions of his discharge and why he was discharged. Based on your previous posts, was the discharge for medical reasons based on his injury at WP.

So there is no official grace period for commissioned officers and paying back tuition?

The service obligation for a graduate from WP is 5 years, 4 years for Scholarship ROTC. I don't think I ever read anything in the Contract regarding a Grace Period.
 
No chapter, just a GOMOR, so far? If I understand correctly.

Oh, the good news is GOMORs don't "officially" lead to separations. However, he maybe a terminal 1LT or CPT.

Thank you LG. I had looked that up before, but couldn't find what I was looking for in regards to tuition payback. Could you direct me to the page in the AR if there is one. I am not used to AR's.
 
Oh, the good news is GOMORs don't "officially" lead to separations. However, he maybe a terminal 1LT or CPT.

They can lead to a board of inquiry, requested either by the officer's chain of command or next promotion board. A board of inquiry could require an officer to "show cause" for retention. If that occurs, the officers would have to demonstrate to the board why he/she should be retained. If it gets that far, though, the board will most likely vote to recommend that the officer be separated from service.

Recoupment
Officers who participate in certain advanced education programs sometimes fail to complete their educational require- ments, or AD or RC obligations. These officers are subject to the recoupment provisions of AR 37–104–3. Recoupment must be accomplished prior to the separation of an officer who has not fulfilled the service obligation incurred as a result of participation in that advanced education program (10 USC 2123 and 10 USC 2005).

1–16. Recoupment
Individuals who participate in certain advanced education programs and fail to complete their educational requirements or military service obligations (MSOs) (Active Army and/or RC) are subject to the recoupment provisions of AR 37–104–4, chapter 31. This must be accomplished prior to separation of an individual who has not fulfilled the ADSO incurred as a result of participation in that advanced education program, in accordance with applicable law and regulations.

31–1. Applicable education programs
Recoupment will apply to the following education programs: a. Advanced Civil Schooling Program (ACSP).
b. Chaplain Advanced Education Program (CAEP).
c. Health Professions Scholarship Program (HPSP).
d. Judge Advocate Advanced Education Program (JAAEP).
e. Long-term Civilian Training (LTCT) Program.
f. Senior Reserve Officers’ Training Corps (SROTC).
g. Uniform Services University of the Health Sciences (USUHS). h. United States Military Academy (USMA).
