Medical Denial - Chance of Rebuttal?

DS was on National Wait list as Hold applicant. However, received notice that his Medical Waiver Denied due to history of shoulder instability so he was removed from List. He had a right shoulder labral tear one year ago. Fully rehabbed with PT ( no surgery). Took him to orthopaedic MD this week - full range of motion with no instability. He also started and played every Varsity football game as Offensive Left Tackle this year and is now wrestling at Varsity level. He has had no issues. I believe he was probably denied since there was no current medical info and my son did wear a soft brace under his football pads just as added protection. However, it was not prescribed and obviously he has no issues if he's wrestling and his shoulders are twisted and turned every which way. We plan on requesting a rebuttal of his denied medical waiver and will submit current medical status. Any thoughts from anyone?
 
If you took him to dr they need to submit their notes from this weeks appointment and a letter stating everything you said. Resubmit immediately. if the only objection was there was no new medical opinion, you resolved it this week with the Ortho.

I hope this is the case; his athletic trainer and coach at school who is also a Physical Therapist is also writing a letter. Thanks.
 
Who initially requested the medical waiver that was denied? When my son was initially disqualified due to an arthroscopic knee surgery years before, the Academy request a waiver on his behalf, and we were contacted to provide additional information. We then provided new x-rays and a doctor's note, and it was accepted, but it was too late in the process and no appointments left for that year - waiver came after May 1st. Because of that, my son was offered a spot in the NMMI, the prep school for USMMA, and spent one year there before joining the class of 2019. Please feel free to PM me if you need any more info.

Agree 100%! get the ortho letter and a PT letter (if you can) in ASAP. Especially since there was no surgery, this should be resolved fairly quickly. - Hope this works out for you, and good luck.

DoDMERB initially DQd him and it was Pending Request for Waiver with the USMMA. All they had was the MRI and original doctor notes from a year ago, and then a letter from my son stating that he wasn't having issues but did wear a soft brace under football pads. We are new to all of this, and had no idea of the need for a Doctor to verify, etc. He was denied a Waiver request from the USMMA and therefore found medically DQd "based on a review of the available medical information". He was seen this week from original orthopaedic doctor and doctor found no instability, no pain, and full range of motion. We will submit new medical information this week and request a rebuttal. Praying for consideration.

MD, MD, MD!!!! Physical therapist and trainer will not hold weight legally or with Govnt.

We did receive a letter this week from Orthopaedic Surgeon noting, "On exam today, he has full pain-free range of motion with no clinical signs of instability or labral pathology today. Therefore, he is deemed fit to enlist in the military with no restrictions from our standpoint.". We were going to submit the MD letter along with the trainer letter just as support as well.
