Second Remedial

So my status changed on the DoDMERB portal. They've received my AMI and are reviewing it...
HOWEVER it turns out there is now a second Remedial, for when I had Sleep Apnea and had to have a sleep study done when I was 10.
I no longer have sleep apnea, and have had no occurrence since my tonsilectomy when I was 11, which cures Obstructive Sleep Apnea by clearing the airway.
I was supposed to go for another sleep study just to make sure, but a year later when I brought it up to my doctor he said that since my growth had not been stunted after the surgery that there was no chance of me having sleep apnea. Sounds good.
The problem is that I am unsure that I have any formal paperwork which states that I no longer have sleep apnea, the evidence being my continued growth.
If this is the case, will a note from my doctor be enough?

Because you have TWO waivers pending, I would suggest you contact Dr. Merchant at DoDMERB consultants and get some professional advice.

HassamaMama - These are remedials not DQ. No waivers are actually pending. It can't hurt to contact the DoDMERB consultants but if you provide whatever is requested based on the remedial code you should be fine. What does the code indicate? Provide medical records regarding xxx? See a physician about xxx? Complete a sleep study....

It is likely that providing the statement as you indicated, that subsequent to the tonsilectomy on xx date by xx Dr my Dr said i no longer have sleep apnea. Include a statement from the Dr. that you no longer have sleep apnea if that is the medical status. You might not require a waiver at all.

I'm no Dr. and because of what is at stake with this medical waiver process, we decided that it was better to be safe and consult an expert re: what to submit and how to respond to requests for information. For that reason we went with the consultant...

Dr. Merchant www.dodmerbconsultants.com was wonderful and very helpful to us as my son when through the waiver process. I highly recommend him. My son was waivered very quickly.

What does the remedial ask for?

If they want medical records and do not ask for a medical opinion

Simply state:

The issue was resolved when I had the tonsillectomy described in section X of the DoDMERB packet. (Assume you told them about the tonsilectomy)

No follow-up medical treatment was sought or deemed necessary. I have had no issues in this area since the tonsillectomy.

There are no additional medical records to submit.

End

You don't need a consultant, you need to respond with exactly what they requested. Not one thing more or less

You had a medical event 6-8 years ago which is relatively routine

If you research the DoDMERB forum, you will find this type of response will be more than sufficient.

And to be very clear - this is a remdial not a waiver. Remdials almost always are about nothing more than bureaucratic paperwork.

Do Not get a doctor to write any type of note unless it is requested in the remedial. The only thing that will do is open the door to more questions.

Ouch. Sounds like they want you to follow through on the sleep study.

They are not asking you to follow through on the sleep study. They are asking for medical records related to it

You checked a box. DoDMERB is required to ask about it. Send them what they ask for and nothing else. If there is 'nothing else' DoDMERB will be ok with it just tell them there is nothing more. They may then ask for more later, but highly unlikely

This is a paperwork exercise!!!

Read the DoDMERB forum. Virtually all remdials are simply satisfying a very simple request

+1 @Cerberi They want the documentation related to the sleep study you had performed. Gather that information. If there is a follow up report from your doctor include it.

But they didn't DO the follow up study, maybe I'm not clear, I'm assuming he provided the paperwork for the first...hopefully the doctor can provide notes that it wasn't necessary. I agree nothing more than necessary.

He checked a box on the DoDMERB form and stated he had a sleep study at 10 that was corrected by a tonsilectomy at 11. My guess is the tonsilectomy was listed in a separate section otherwise the form would say 'sleep apnea resolved by tonsilectomy, no follow up all good'

Essentially, his family got scammed by a doctor that owned a sleep center as a regular pediatrician would have said 'your tonsils are the problem'. (Has anyone ever had a sleep study and not been diagnosed with sleep apnea?)

DoDMERB read his form until it got to bronchitis stopped, asked for paperwork, received paperwork, read to 'sleep study - sleep apnea' asked for paperwork

It's a flowchart/checklist.

The only paperwork he provided was the DoDMERB form and DoDMERB is reading down the list. It is probable that the list isn't even being read by a medical professional

Send the tonsilectomy report and state issue is resolved no follow-up required.

So I just received the letter from the DoDMERB which says I am DQd for the following reason:
D241.30 - Asthma/reactive airway disease/exercise induced bronchospasm after age 13
From what I have read, it is up to the USNA to now provide/request a Waiver for this, even though I have no airway condition at all and I have excellent stamina.

I also have been requested the information for the Sleep Center as my second remedial, which will require me to go to three different centers to request all of the paperwork and then wait for probably two weeks for them to send me the required paperwork.

My parents are now annoyed and telling me that I will not get in because of these circumstances, and essentially that I should just forget about it and go with the "easier route" which is to go to my safety school which I have been accepted to. Reality is sinking in and they are telling me that it is most likely going to be impossible for me to get in.

I want to go to the USNA more than anywhere else so I can fulfill my dream. I don't know how to explain this to them, since they are biased to not favor the idea and my grandparents are not exactly on board either for the same reasons as my parents. They would all rather I go to a Civilian school and not pursue service. I love my family but this is something I feel like is more than just something I want to do, but something I must do in life.

Are there any words of advice or information that I can give them to help convince them? They have agreed to try and get all the necessary paperwork but are also telling me to expect that the USNA will not accept me.

Any help/advice is appreciated.

I don't know anything about this, but this sounds like the ball in the USNA court. If they come back to you and request additional info you can then gather all of the information. I would wait to hear from them.
