Cadet Suspended from West Point after getting beaten by Singers entourage

If the action taken in in a court, even military court, it is releasable at some point. Administrative action, without the permission of the individual, is not releasable. There are ways to push that, but it could end up biting the public affairs office.
 
I sincerely doubt that here is more 'evidence" in this case other than a couple of witness statements and the video. But I appreciate your explaining to me what I do and do not know. But again, I may be pleasantly surprised one day if the HPD whips out the smoking gun showing what either side did that day. But based on my experiences, which is all I have, I don't expect it to happen. Most arrests are made with allot less than we have seen.

Maybe a jury of our peers will look at the video and be able to come to a mutual decision.

Thanks for letting me participate on this thread. I'm outta here before I am kicked off. I have really enjoyed the last few days. I hope that I may have turned at least one person over to my side and have not turned too many folks off. There is nothing better than opposing opinions to make the world go round. I have learned allot since I first joined SAF. I am going back to the world of the lurkers so I can see what is happening at the two academies my kids are at.

I have been spit on, beat up, spent time in the OR and been shot at twice. It seems like a safer place than staying on this thread...

Jeremiah Weed- We used to tailgate pretty good post lacrosse games up on the Hudson- most of our parents were from Long Island or Upstate- ie...Cuse). Our starting freshmen goalie (4 time All American) my senior year used to have the WEED brought by his parents. Surely plenty of beer to be had- but the WEED got hit on pretty good. Post game tailgates now are alcohol free......My how the times have changed......last saw the goalie's dad (may he RIP) in the 2004 timeframe up as we had an alumni team that was partaking in the Annual lake Placid Lax Trny. Said dad was packing the WEED-I did one shot-
 
For the record: King was on track for a December graduation, not May.

(So add 6 months to every post that says he was 3 months from graduation. :thumb: )

OH...you can't miss this one. It's HUGE...out in front of the stadium in the lot...there'll be a lot of "other" things in the area but THUDGATE...you'll see it.

My son, a mid at the USMMA, came home this last weekend after being at sea for the last 8 months. He had sailed on a container shop and an oil tanker. Along with other countries he visited mainland China three times and was in the Middle East twice. He said that he had even seen the hazy coastline of Somalia and he had stepped ashore in three countries that were on the State Department's travel advisory list.

After reading about Cadet Kings horrible experience I was more worried about his trip to the airport and his time in the terminals in the Middle East and at Laguardia than anywhere else he had been. We should not have to worry about our kids being assaulted in the dangerous environment of a domestic airport.

And THAT is the last thing I have to say on this thread.

The best defense is a good offense. I guess that holds true in the legal realm as well :rolleyes:
 
I understand that, but even if she won in a civil court how much would she be awarded? I highly doubt enough money to cover her legal expenses. Glad to know someone in this economy has enough money to pour good after bad!

Counterclaims in lawsuits are often asserted in civil cases to make the plaintiff blink and perhaps back off the claims he or she is making. Sometimes they are proper, sometimes not. Frivolous counterclaims should NEVER be asserted, but it is often up to the professionalism of the particular lawyer involved (don't need to explain to everyone that there are bad apples out there). Unfortunately, some lawyers assert counterclaims solely for the ad terrorem effect. In my type of litigation (patent litigation) counterclaims routinely fly around all over the place as sort of a "mutual-assured destruction" (basically saying, "well, if we infringe your patents, then you certainly infringe ours -- by bringing this lawsuit, you risk bringing down your entire company!"). It's akin to finding yourself in the kill-zone of an ambush, where the best way to get out of it is to return overwhelming fire.

Considering that the cadet has no memory of the event, I guess the singer and her posse can claim he said anything imaginable and he has little or no ability to rebutt. And since no official charges were brought, I imagine it will be impossible to have statements taken at the scene available...

I suspect the singer has more to lose than the cadet at this point though, so I'm not sure if this strategy is going to be effective.

And heaven forbid this poor cadet gets injured or killed before returning to WP. The lawyers will have a field day if that happens...

True as much as the singer doesn't claim he was covering the phone with his hand as he was dissing her. I'd love to see it on Judge Judy for laughs. :yllol:
 
It seems that stories like this always come down to the lowest common denominator - it's racial and sexual! There is not a peep out of the celebrities camp since the incident in March and now, after all this time, she goes public with some slurs allegedly hurled at her? It seems that the Cadet got allot done while he was off camera for those 3-4 seconds! Give me a break!!

We say that a strong offense is better than a weak defense......
 
Well, what a mess. I could be incorrect or misread the news articles but I recall that it was reported that her limo windows were up and that she only rolled it down(halfway) to get the attention of her body guards in order to get the cadet away from her luggage. How in the world did she hear anything? Heck, you can see the limo windows up on the youtube video. I guess Al Sharpton will be showing up next.

HOUSTON (KTRK) -- It all began with a video showing a scuffle between Patti LaBelle's entourage and a West Point cadet. At first, it was a case of he said, she said. Now two people have been charged with a crime.

We were the first ones with these charging documents on Friday afternoon. We can tell you LaBelle's hairdresser and bodyguard have warrants out for their arrest; both are charged with assault even though the original story to police painted a much different picture.

There was no audio of the March 11 incident at Bush Intercontinental Airport, but according to court documents, the video speaks for itself. Patti LaBelle's bodyguard, Efrem Holmes, originally told Houston police he was just defending LaBelle's son. After watching the video, three months later, an officer reached a different conclusion.

In the video, you see West Point cadet Richard King in yellow on the phone near LaBelle's limo outside Terminal C. King exchanges words with her son who is also her driver. Her son bumps King. The bodyguard then hits him and both he and LaBelle's hairdresser, 63-year-old Norma Harris, push him into a concrete pillar, causing him to fall to the ground with a head injury.

LaBelle's entourage was the first to contact police that day claiming assault. Attorney Geoffrey Berg says the new charges don't back that up.

"Everybody is entitled to the presumption of innocence, but at this point in the court of public opinion, it looks like the weight of the evidence is on the side of the cadet," Berg said.
