Interesting that the article states she ‘may’ pursue this. My guess is that she won’t move forward with it, rather, she just wanted to bring this front and center and make people pay attention.

That's not what is said. The Judge is ruling that she "may" sue, i.e. that she is allowed or has standing to sue the two named officials. A suit against the United States has been dismissed. She is most definitely moving forward with it.
