Obtaining Patents at USNA

I am a current mid, I plan on applying for some patents, I have heard rumor that as a mid USNA somehow has rights to patents you apply for. Can anyone confirm? and please provide sources if you have any.
 
I think there was a court case about this... If I remember it's not a USNA thing it's a college thing. I don't remember the results of the case though
 
I think you are talking about Stanford, and that case was against an employee. But still not sure.
 
There should be an instruction that addresses this that you can access on the intranet. I know it is addressed for faculty. Also, JAG should be able to tell you or call a community attorney who is a USNA grad (they may tell you for free) and many advertise their USNA association or former JAG status.
 
The current intranet is not user friendly, if you try to easy button and do a search function it links you to the library guide on the us patent and trademark office. But yes, I can go to a JAG, just trying to have resource answers to be able to have an informed discussion.
 
As a Mid you are getting paid by the US government and are using USNA (i.e. government) property for research. I think you would need to share with USNA/government, at best. You might want to look for University vs undergrad cases on intellectual property ownership and also employee vs employer cases on the same to get a feeling for what might be important in your case.
 
While I agree that I am a Mid, it is not uncommon for military personnel to hold a second job, for example I had a chief who worked at lowes for the discounts. Also there is no evidence that we would use military property for research. That can be done just as easily on personal laptops. But I will look into some university v. undergrad cases. Do you have any recommendations?
 
It is different legal research when your university is the government. When you get enough posts to PM send me a message. Intellectual property law is super tricky so I need details before I can direct you to the right resource. Most universities allow students to own their research-the government usually does not. Your answer is highly fact defendant.
