Two Cadets Face Court Martial for Sexual Assaults

LITS, are you stating for the record the following....

The civilian accuser DID NOT drop all charges.
The football player and his accuser DID NOT have a prior romantic relationship.
The accuser of the football player DID NOT ask to be released from her service obligation to the Coast Guard.


For the record... I do not know either of the accused or either of the accusers. I make no proclamation of their guilt or innocence.

I don't understand, why would current cadets (not involved with these cases) not be trusted to be truthful or forthcoming? Why aren't their opinions and observations relevant in the court of public opinion?

Why is it so hard for you or anyone to believe that many cadets would side with their classmate as opposed to a civilian in a he sad/she said incident that the charges were dropped?

Why is it so hard for you or anyone to believe that cadets would align with their classmates in a he said/she said incident along gender bias?

Are there no lessons to be learned here? No cautionary tales? Are you simply basking in the glory of another cadet's demise?

I'm saying your not likely getting the story right. And I'm saying that's probably your cadet's fault.

Just to clarify.... Miranda is only necessary if a suspect is being questioned. I can arrest a person who has a warrant for their arrest and not read them Miranda as I am not questioning them as a suspect in a crime, I am arresting them on the warrant. If they utter something like "I just killed somebody" I still have no legal responsibility to read them Miranda because I am not asking them questions. I will let them talk all they want. Completely legal. But if I plan on a custodial interrogation you had better believe the will get Miranda in front of a witness and on video along with a written form to sign. It's not like the movies folks.
 
A spontaneous utterance of guilt.

The unique thing about the military is Tempia warnings..... because military members may not feel they're free to move/leave even if they're not technically in custody.
 
The 2nd cadet was found guilty on Friday. He was sentenced to 8 years in prison and dismissed from the service.

8 years is definitely ridiculous for something like this that would've gotten him probably a year or two max in the state criminal justice system.

I don't see why it's necessary to re-state that these are "bad" kids over and over, unless you have some deep seated insecurities and want to convince yourself that you are relativistic-ally morally superior. Bad and good are definitely relative terms, and in the end, relativism means nothing. But go on and keep telling yourself how bad these ex-cadets were.

I feel as though Miranda should be read upon detention. It's human nature to try and explain yourself when you get caught doing something and (conveniently) self-incriminate. People in general aren't educated enough on this topic, and it needs to change.

From your post, you only care about reading Miranda when its a possibility that not reading Miranda will make their interrogation inadmissible. This is morally wrong. Law enforcement exists to protect people's rights, and this includes the rights of possible felons and people who don't understand the system.

Most people come to these forums looking for assistance with applications and admissions questions. This site delivers on that with a wide variety of knowledgeable and experienced posters. Parents, current cadets, former cadets, admissions partners, official academy personnel, etc... all contribute to give a fair and accurate portrayal of New London and the Coast Guard. In that spirit, please do not think that the CGA is fostering an environment that is hostile toward female cadets.

These incidents were separate and unique. One off campus, one on campus with two accusers two years apart. There were investigations, court martials and both were sentenced to prison. We should all respect the process and the conclusions of the UCMJ.
 
As always, it's also important to point out that the Mission to to Graduate young men and women with strong bodies, stout hearts and alert mines.

Somewhere in a four year process cadets who don't measure up to the opening of the Mission Statement should leave.

You are close to your classmates, male and female.

My class had the first Court Martial and it was hard for the entire class (not to mention the victims).
