Anyways, just to give an idea of how long this topic has been debated, please read this document. As far as I know it still gets quoted often within the Marine Corps and it is known to have good legal footing in the arguments made within the document.

Very few graduate school dissertations are ever read by anyone, much less the troops, so I assume he deserved an "A". These are simply the thoughts of a single individual required to make a thought-provoking presentation as part of a school curriculum. However, his presentation on the legality of it probably does hold water. His thesis is a far cry from a DoD sanctioned study which apparently has been received positively. I think Sec Gates only promise is that nothing will be done during the present hostilities.
