denied-can you fight it

My son just received a denied waiver for afrotc, for asthma. We had him tested at the allergist, passed, had him take methocholine challenge (scored only a 13% change-20% is asmathic).
So, my question, is can we "fight" this, and if so, what else should we do--anyone been there? We are talking to the POC's and will call the #'s on the form, but we are searching every avenue we can for help--TIA!

chparent, first, don't "fight it", you're better off banging your head against the wall (but don't do that either!) I would suggest you learn the word "appeal". You may have a better chance and getting a waiver with an appeal. Be aware, somethings can not be waived.

I suggest you contact Mr. Mullen on this forum. If any assistance can be mustered, he's the one to go to. I think though the waiver has been reviewed, so you are well along in the process. You can find his contact info with a simple search.

Anyway, Mr. Mullen, can you assist here?

This gentleman is THE source of information and is, in fact, the Deputy Director of DODMERB...he KNOWS what's what and can tell you the facts!

He's also extremely approachable and helpful!!!

I've dealt with him a couple of times...and was STUNNED at how quickly he helped me.

Contact him...send him your son's full name, last 4 of his SSAN, and the facts...and let Larry work with you. He won't guarantee a "good" result but he will ensure you understand ALL.

I just stated this on another posting: Send me an email with your posting; your full name and last 4 SSN; and I can assist U better from there. Understand, when a waiver is denied, it is very difficult to overcome UNLESS you are able to provide incontravertible proof that the issue did not exist; the healing has been completed; or things along those lines.

In this case, I would need to look closely at what the complete medical record reveals.

first-i would like to thank Mr. Mullen, as he offered a lot of input. Got us some answers, not really the ones we wanted, answers none the less.
After being DQ and then waiver denied for asthma (due to history), we went again to the allergist who had been treating my son. We took a lot of documentation and ask for help, as we were just told it was because of his "history" and we were not sure what that meant. She called the MD on the letter and found out, history--for all services, there must be 3 years with no medication and a "clean" breathing test result.
So, he won't be in the AFROTC, but with that info, we can live knowing there is still hope if he wants to try in a few years to enlist, but also, that there is a good reason and it's fair!
Wishing all those trying to get waivers the best and hope you will be able to soar with the AF!!
