Enlistment agreement with ROTC contract

My kid just finished his freshmen year and may not continue the program. We looked at the copy of form 597-3 he signed previously and saw that he would not be obligated for active duty or reimbursement if he withdraws form the ROTC program(4 yrs) before the first day of MS II year. How's about the reserve duty or any service obligations mentioned in enlistment agreement (DD form 4)? He recalled signing enlistment agreement while contracting. Thank you.
 
If he leaves prior to start of sophomore year, he is under no obligation whatsoever.
 
The enlistment agreement mentions the active duty and reserve one. The wording on ROTC agreement only says that the cadet is not obligated for active duty. It does not say anything about reserve service portion. Will he still be on the reserve list if he withdraws?
 
Gee, I thought NO OBLIGATION WHATSOEVER was pretty clear. He will not be on the reserve list. He will be subject to call up in the event of a draft, just as he would be if he had never done ROTC.

Please look at page 4 of the contract. It only mentions about the active duty not all.

DD Form 4 lists both active and reserve duty.

Any source on no obligation would be greatly appreciated. Thank you.

If he is on ROTC scholarship, he has no service obligation as long as he drops out before the start of sophomore year. That's the standard agreement. If in doubt, he'll get the most definitive answer by simply asking his cadre. That's much better than hearing from anonymous sources on SAF.

Look at the contract, Section 2a, Genersl Cadet Agreement. The enlisted contract covers the reserve status during the period assigned to ROTC.

Then, see the paragraphs further down addressing disenrollment after the first year, where enlisted service may be required for cadets who came from civilian status (prior enlisted are separately addressed) as part of a recoupment. The enlisted status is already created, and the cadet would be ordered to enlisted duty. But not prior to the first year cut-off!

Thank you for your reply. Please point out on where in the contract explicits that the cadet will no longer be obligated for reserve duty prior to the first day of MS II. Thank you so much.

Part of that paperwork will consist of their being informed that they are not required to reimburse previous tuition payments and that they have no service obligation (active or reserve) to the Department of Defense.

They will be required to turn in their uniforms, and NROTC text books, and any other supplies that were issued to them. Should they have any questions, THAT is the time to ensure those questions are answered.

To be frank, for anyone reading this, if you are truly concerned over potential obligations for an enlistment contract, those concerns should be addressed BEFORE you ever sign the contract. This seems obvious to me, yet I used to get questions all the time as to what was in the contract.

If anyone here needs legal advice as to what they have committed themselves to (or what your DS or DD has committed to), then it would be best to retain professional legal advice.

It would honestly differ state by state. Most universities have a Veterans Affairs office on campus, and they may know of people who specialize in legal issues surrounding enlistment contracts.
