Hi,

This is a really random question, but i’m 19 and i was selected for jury duty. I’m applying to USNA (still cpr) and i wanted to ask if jury duty is waived for midshipman? I moved it to January winter break during usna break to be safe but I wanted to see if it would be waived if I get in.

Thanks!

If you are a full time college student, you will be excused by most courts upon request. At least that is the rule in my state. Here is the Florida rule:

(11) Upon request, a full-time student between 18 and 21 years of age, inclusive, who is attending high school or any state university, private postsecondary educational institution, Florida College System institution, or career center shall be excused from that specific summons for jury service.

Connecticut doesn’t allow that, only postponement so i had to postpone to winter break.

It depends on where you live. Every state is different and even counties within each state vary. You'd need to look to your county's procedures to get an accurate answer. In general, being temporarily away from the jurisdiction is an excused absence that will grant you a continuance and you'll get another summons when your name comes up again. But some counties may remove you from their list based on being active military. It just depends on your home county.

In my experience as a trial lawyer, no judge would put a student at hardship by forcing them to sit on a jury. Nor would the attorneys from either side of the case want a juror to be forced to serve.

^ This, If you get a jury summons, call the local Court Administrator, explain the situation and they will either excuse you or defer until you are able to serve. Some jurisdictions may have an automatic military exemption. NJROTCC is also right, but the Court or counsel excusal wouldn't come until you actually appear for jury duty. (As an aside, most litigants don't want an grumpy old conservative lawyer from serving either !)

My MIDN just got notified. He said there was no disqualification for AD so he moved it to Jan 2.
