All candidates should take this example to heart, as even being this close (174 days) to graduation/commission you could still be separated/dis-enrolled and have a hefty tuition tab to repay upon conviction for such ALLEGED crimes.

You guys are right this doesn't look good. I just hope this is not swept under the rug. It seems all the homeowner may want is him to pay for all damages and apology. If he does these, it just might help. If he were my son, well that's all I will say.

Former prosecuting attorney here. This has been charged as a burglary. That sounds serious--and it is--but my research shows there are degrees of burglary under Maryland law, and this is fourth degree burglary, the least serious. It is categorized as a misdemeanor, not a felony. This is the kind of breaking and entering that tends to happen when the perp is soooo drunk, he bounces around aimlessly, causing mischief and damage with little or no awareness of what he is doing. It's also the sort of offense, that if engaged in by an otherwise disciplined and intelligent person, is likely to happen about the age this mid is, and is unlikely to be repeated if the perp is arrested and prosecuted. The prosecutor and judge are likely to give this mid a break. Whether the Naval Academy will as well, remains to be seen.

I'm confident that the new administration at the USNA will not consider his status as a star D-1 athlete nor his father's rank (Rear Admiral) or his family's USNA connections (grandfather, father, uncle and brother are all USNA grads) in deciding the punishment for this Mid if he did ALLEGEDLY commit these crimes.
 
I don't think the Naval Academy needs to consider if he should 'get a break'. This will be in the hands of the Navy. He does not need to be found guilty - if he is tried in civilian court.
The Navy can and probably will separate him on conduct unbecoming an officer under UCMJ. Yes, this code also applies to cadets and midshipmen.

The verdict will seal the legal outcome; his Naval career is over.

I'm also a retired JAG (judge advocate). I have been involved in the prosecutions of hundreds of cases. In my day I was known as a fire-breathing, take-no-prisoners prosecutor. All I can tell you is my opinion of how this case (under facts as reported) stacks up against the cases I have been involved with. All in all, and judged from my perspective, it's not as bad as it might look to someone who hasn't been exposed to the range of criminal cases that I have been exposed to. His age is the primary mitigating factor in his favor.

If this young man accepts full responsibility for his actions and has an otherwise squeaky clean record, he will be treated leniently by the court system--and he should be. In five years, maybe less, he should be able to have this expunged from his record. Assuming he keeps his record clean, this isn't even likely to prevent him from obtaining a high level security clearance if someday he should require one. His father's rank and his athletic endeavors should neither count for him nor against him.

I had a classmate kicked out the week of graduation (day or two before).

I realize this was just some "after Branch" (what ever the Navy calls it) prank but, what would some 21 year old longshoreman's son (without...up until this incident, a clean record) have been charged with in this type case? I'm going to take a wild guess and say it would at the least be: drunk and disorderly: and Home Invasion with felony charges.

It's will also be interesting to see what the other (no big name parents name) Midn. will end up with in his even lessor charges?

A trial date has been set in the civilian criminal court system.

Mid charged with breaking into home expelled

A Naval Academy senior and admiral’s son, charged with breaking and entering an Annapolis home in early December, has been kicked out of the academy, a school spokesman confirmed Wednesday.

Michael Guadagnini was discharged from the Naval Academy on Tuesday, academy spokesman Cmdr. Joe Carpenter said. The former midshipman first class faces charges of breaking and entering and malicious destruction of more than $500 worth of property after allegedly trespassing on an Annapolis residence on Dec. 2. His trial date is March 14.

An Annapolis attorney representing Guadagnini declined to comment. Guadagnini is the son of Rear Adm. Mark Guadagnini, commander of the Abraham Lincoln Carrier Strike Group.

An old news story with a resolution. Must say, personally, I could really care less about this story at this point in time.

Ah, now I'm having flashbacks to standing inport OOD in Key West...and I remember, that will never happen.
 
He is lucky he didn't get shot by the homeowner!

Stupid actions have consequences. He lost his degree and probably his career.
