DS application in pending status. All appeared good and we just waiting on DODmerb to complete their review. Just got word that we need to supply AMI and DS was going to be DQ'd due to food allergy(tree nuts only). How does waiver process work and what are his chances?

I suggest using the search bar and looking up DQ on allergies for specific information. USNA will request a waiver if they deal him competitive. They will not communicate with you that they are pursuing the waiver you just have to sit back and wait. I am not sure if they will tell you they are not requesting a waiver. But if they do request one they can do three things
1. deny waiver
2. Ask for more information
3. Grant waiver
The workflow diagram is here https://dodmerb.tricare.osd.mil/Content/MedicalWaiverConsideration.pdf
If they ask for AMI provide everything that they ask for. If/when the waiver is granted the status will show up on the DODMERB portal and you will get a letter from the Navy in the mail telling you your status.

What he can do now -
1. Send email to admissions representative saying that even though he is DQ Navy is still his first choice and that he hopes they will pursue a waiver. Stay out of the specific medical issues though as they can only see if he is DQ medically and will not know what for.
2. Work on plan B-F
3. prepare to wait waivers can take a few months.

Good Luck

Should DS go ahead and email his admissions rep now before DQ is official? We are in the "Remedial" stage currently according to his Dodmerb case worker. She states that once the AMI is in and processed the DQ will come. AMI will be forwarded to DODmerb today.

My son was medically disqualified by DODMERB in October for astigmatism above 3.00. He was told that if they appointed him then the waiver process would start. He checked his portal today and it stated Required Actions: Complete Medical Qualification Exam. Why would it say that if he already completed it and was DQ'd ? Everything else is complete. His application status states: Complete Pending Review.

This is so stressful for my son and I figured I'd ask and see if anyone had experience with this.

My status stayed on Complete Medical Qualification Exam until I got the waiver. I have not been appointed to USNA yet and I got the waiver several months ago.

We are in the waiver process right now as well for a very mild tree nut issue. Definitely not anaphylaxis but had been documented in records so we had to respond.

As I understand it, up to 30% or more of the class usually have to get some sort of waiver. Some SA's like the USAFA are much more rigid about never giving a waiver for food allergies. Others like USMA and USNA are more flexible depending on the severity. It kind of makes sense as they really want to make sure that their grads are capable of world wide deployment without restriction. You could imagine that you could put both your fellow sailors and marines in jeopardy should your DS/DD have a serious reaction so makes sense for them to be cautious. I don't think the DoDMERB has a lot of flexibility in interpreting the rules thus the DQ's are more rigid. The waivers are determined by physicians at each of the requesting SA or ROTC command and have more flexibility in determining what they will waiver.

My understanding is that the waiver process depends a bit on how competitive your DS/DD are in the applicant pool. If they are not competitive, I don't think getting a waiver is considered. If they are competitive, I think the SAs are much more likely to submit for a waiver review. My DD had gotten an LOA back in December and my understanding is that these applicants are automatically sent for a waiver review which is where we are right now. We had submitted the AMI for this back in December and they had asked for some medical records and such. I understand some others in the past have gone as far as to be requested to have food challenges to document how allergic or lack thereof they are to tree nuts.

Our story is a bit complicated but if you PM me, I am happy to share what information we have. Depending on how many posts you have, you may not be able to PM someone until you make a couple posts but just a quick couple posts should be able to give you that ability.

Good luck!

I understand the stress and wish we could make it all go away for them! My DS was DQd for an old shoulder injury from football (which required absolutely no medical intervention but did require an MRI to diagnose). That was in September. He received his LOA (Application Status) with Medical Qualification (Required Action) listed on his portal page. He is a recruited athlete so his circumstance may be a bit different. Either way, the Waiver process just begins on it's own from what we're told....in other words, you aren't involved in the process unless they ask for more info. I also do know that my son has had a bit of frustration with the portal being a bit "behind." Hope this helps.
