I was disqualified 1) diagnosed with ASD at age 4 - however, my private doctor CAPT, PhD, ABPP DEVO PEDS states that I no longer meet criteria for ASD; 2) academic skills disorder - I was never diagnosed with this; I had an IEP until 8th grade then switched to 504; I have always been a high honor student graduating with a 4.9 gpa; color vision deficiency (I have never been privately diagnosed with this). My doctor says it's worth fighting because she has followed me since age four and knows all that I have done to overcome my diagnoses. Thoughts? Where do I start the fight?

Mr. Mullen can give you much better answers, but I believe for similar situations , a 504 was treated similarly to IEP. It comes down to the individual and what accommodations they have.

This thread discussed IEPs and 504s related to ADHD...

Taking the long view, and let’s say you cannot get waivered this year, executing your alternate plan by excelling in college (and hopefully ROTC) without any assistance in advanced, tough courses similar to first-year SA academic curriculum, MIGHT be a strong counter-balance if you become a re-applicant. You have a window of a few years, and people do re-apply 2-3 times and some eventually succeed. This would have to be accompanied by up-to-date evaluations by appropriate healthcare providers documenting you are able to function with no additional support or accommodation. These are only unofficial thoughts based on the years of comments I have seen here.

Your standardized test scores must be free of accommodation as well.

The color vision deficiency - for some SAs, it’s very difficult to get a waiver. There are many, many threads about this. Are you saying it was never diagnosed before your DoDMERB exam? Is it your position you are not color vision deficient? Mr. Mullen, as always, will have better insights on that one, though the waiver authority does not reside with DoDMERB, where he is the Deputy Director.
