As retired LE I continue to be amazed at the way routine-looking state crimes, i.e. those w/minimum sentences, catch & release, no bail required, can be taken to our friends in federal court!!
Robbing a pharmacy (Hobb's Act?? WTF??)...burning a patrol car...tisk-tisk, for shame...

To those active LE, (& firearm owners) out there, suggest you subscribe to the ATF's website, lots of knowledge over there...you know, for that special perpetrator...The one who needs to constantly be reminded (for the next 5-10) that, "If you can't do the time, don't do the crime!!"

My favorite federal crime:

Exciting premise for a TV cop show.

Wonder how that law was debated in Congress?

Good news for the law-abiding citizens of Chicago; just need about 1K more & some bad people might figure it out...
BTW: There's something called the Kingpin statute, seems part of a RICO ...essentially life.

I rely on the Castle Doctrine.. If they end up outside I drag them through the window and hope CSI doesn't notice the drag marks down the driveway.
 
Interesting .. I think the LE community is learning this lesson where in those communities where the state prosecutors are releasing criminals on a catch and release basis. I hear the shock effect of dropping a repeat miscreant into the federal system gets their attention, fast !
 
"Happy wife, happy life!" Advice those engaged in criminal enterprises with federal jurisdiction would be wise to follow. For your consideration:


36 y/o perp with 4 felony priors looking at federal time for mere possession of ammo. Being convicted of a felony in NYS is hard. These cases are usually plea-bargained down to misdemeanors thereby ensuring a high % conviction rate for the local DA. It all went south when the cops were called in on a domestic disturbance. Max penalty is 10 years & 250K fine. With this being his 5th felony conviction...looks like he might be doing a "dime."

Here a perp is charged with possession with intent to distribute marijuana, and possession of a firearm in furtherance of drug trafficking. Max penalty is life in prison & 1M fine. Marijuana is still a Schedule 1 Drug Offense. Again the perp's undoing began with a domestic disturbance call to PD.

So glad to see NYS LE taking more & more cases federal as the current state court system is a joke. The perp is not the victim. The victim is the victim; esp. when firearms are illegally possessed.

In this month's edition we find that after making the news a few years ago for viciously slapping a 13 y/o over a road rage incident where the vic was on a bicycle, we find our current perp, a M/W, confronting George Floyd protesters. As the group starts to surround him, an African-American woman steps up & gets in-between. She tells him to leave which he compiles forthwith. How to acknowledge her assistance 🤔 Why to firebomb her SUV with a Molotov Cocktail, of course. Turns out that's considered possession & use of an "unregistered destructive device"; & that's a federal crime, tisk tisk.

In this case we learn that when one commits arson of a commercial building, (a "Goodwill" store) a building used for "interstate or foreign commerce", that makes the arson is a federal crime! Can't think of any brick-&-mortar store that doesn't have out-of- state or foreign items for sale, but it's a LE interpretation of Title 18 United States Code so...

Mr. Felan's brother, Jose, is wanted for 3 separate brick-&-mortar arsons & Leeroy is being charged federally for impeding an investigation by lying to federal agents & assisting in the flight from apprehendation of Jose.
Leeroy might want to think twice before calling the Feds to provide false statements.

Nice work by the Feds & local PD's...those dang cellphones...they get you every time!

Here we see a 44 y/o man have pics & videos on his Gmail account showing a conspiracy to possess/distribute over 1,000 kilos of marijuana along w/possession of various firearms....allegedly...🤔

What got me was the mandatory minimums for some of the charges:

1. conspiracy to distribute and possess with intent to distribute over 1,000 kilograms of marijuana, which carries a mandatory minimum sentence of 10 years in prison

2. possession of a short-barreled rifle in furtherance of the narcotics conspiracy, which carries a minimum sentence of 10 years in prison to be served consecutively to any sentence for the underlying conspiracy!

That short-barrel rifle just might get him an extra 10 years...Minimum!
Also a lot of interstate transfer of firearms charges-all committed by women!

 
The ATF really likes enforcing the NFA...to the extent they went after guys who printed the outline of a machine gun part on aluminum cards. Their own experts had unreliable results cutting out the cards (with multiple hours of work in each attempt)...still got multi-decade sentences against some middle-class, middle-aged guys without criminal records/any violence.

Well...if you're gonna do something like this, you need to know the law. I was shooting one day when some guys where showing of their Chinese AK-47. Except, China didn't make an AK-47. They had a MAK-90 and had bought an auto sear out of a magazine and installed it. They were spraying ammo all over the range. A couple of guys were really awed by their rifle and asked to see it. Then they asked where they could get one; and these guys were only too glad to show them how they did it.

An hour later BATF arrested them.

If memory serves, they each got 10 years and a HUGE fine.

Dumb.
