When to send doc letter?

I am being dq’d for a non union in my pinky toe. However my toe doesn’t hurt and I can run and do all sorts of activities on it no problem. I have a doctors letter stating this. Should I send this to DoDMERB now or wait and send it to the waiver authority?
Also do you think I could get a waiver for this?
