Lacing other people's food so they ingest medicine or illegal drugs unknowingly is of course illegal. Two university of Boulder students were arrested for bringing laced food to their class for "Food Friday" resulting in hospitalizations. And the reunion felon(s) put your scholarship, your military future, potentially people's health at-risk if they drove impaired despite not having a drink, and took away everyone's choice. I suspect you'll be on the list of "random" selectees now more often and if you get a security clearance they will likely be scrutinizing this story as for-real or a CYA for experimentation. Whoever did this at your family reunion if that's what happened is an ASL, no not the sign language kind.

Asking as if the drug is legal there may be a belief this is OK? It's not food coloring. It's a consent issue, regardless of whether the drug is legal in specific states, this act can still expose those who do it to a potential charge of a second degree assault felony along with a felony charge potentially for inducing the consumption of a controlled substance. Alcohol is legal but if you spike someone's punch with a controlled substance you've also broken the law. My concerns again are not about the use of this drug in this case, but the liberties of those affected and the damages the felon's decisions may cause.

Only the truly insane maybe criminally insane would show up at a “family reunion” and would leave unmarked unlabeled thc brownies on the food table.

And it’s an excuse if used I would immediately doubt as being true.

At a college social it might not be the insane but just the truly stupid that would do the same.

So if this had “allegedly” happened at a college social I might think it possible.

At a family reunion I would think the brownies would be clearly marked.

The delta of what I’m saying and what you’re hearing is interesting. Probably on me to be more specific. I don’t think it’s illegal to possess or bake pot brownies in a legal state. It’s what you do with them that matters. Just fact- serving a controlled substance to others without their permission or awareness is a felony. Anyone wishing to do legal activities with consenting participants is chill with me. Anyone making decisions for others to ingest a controlled substance on the other hand is going to be like Houston ( we have a problem).

Intent is irrelevant. The statute and laws are very clear here for good reason. I didn’t mean to murder someone is not a defense that applies here.

I’m not retained as your counsel or consigliere but you’re welcome to question the law all you wish but that won’t make it less actual. But you believe as you wish. That’s cool with me. Just be aware prisons are full of people who knowingly commit crimes AND those who also didn’t think things were illegal but are held accountable. Good luck.
 
In a legal state, did this person serve a controlled substance as you suggest?

Did the person who baked the brownies tell the host what they were? Did the host forget to mark them?

Did the person who baked the brownies know that someone would eat them without knowing what they were?

Were the brownies made from marijuana or from derivatives?

What state is the person in so we can read the law?

Killing someone without intent could indeed change the crime from first degree murder to manslaughter for instance.

I do a lot of advice giving on a travel forum for a city where pot use is seen as a big deal.

Loys of questions about toking.

The one common advice we give——don’t eat the brownies. Don’t eat the brownies.

If someone takes a toke they get immediate feed back. They can moderate their intake.

With eating there is no such thing. The feed back could be 30 to 45 mins later. You can eat a lot of brownie in 30 minutes while you say—-hey I don’t feel a thing.

It likely would be scary it could easily be terrifying.

And if it kicked in and took effect while driving it could be deadly

Id sure see it as a potentially felony even in a legal state

I don't have anything kind to say in response so this will be my final post on this topic, as you're defending the un-defendable position of a controlled substance being given to people without their consent and implying intent, awareness, location, or those you handed said controlled substance to might be culpable instead. IMPO you don't get it, are presenting as full-tilt determined to continue to not get it, and I don't have time to continue to try to explain it to you. If you wish, look up the Aristophanes quote that starts with "Ignorance can be cured, but..." Good morrow, good day.
 
Haha I didn’t give anyone anything. I didn’t defend their actions and said it was wrong.

I find it funny that anyone can label this a felony without knowing what state this was in, what laws in those states are, who the responsible party is in this situation (the baker, or the host who put them there without the baker’s knowledge), whether anyone told people what was in them, etc.

My advice to my son would be to not eat anything without knowing. The same advice I would follow.

Maybe it is a felony. Maybe it isn’t. Maybe it is a civil matter. Facts matter.
 
I can say that an idiotic member of my family left unmarked 'cookies' in the house. My parent unknowingly consumed two cookies. This parent had never consumed a narcotic (besides prescription) in their life. The neighbors found said parent in a comatose state on the back porch in the rain. An ambulance was called, overnight stay in the hospital. Sadly, parent thought they were dying as they had no idea what had transpired.

Needless to say, I have severed all ties with that idiotic, selfish stoner. Not all families have people with common sense or decency running throughout.

I was hoping this post would drift into obscurity. A pound pound of flesh is being extracted, but hopefully headed in the right direction. Some details were changed to protect others, but the essence of the issue is there in the context of the post. I would be happy for this post to disappear. First, let me say that I have never smoked marijuana so I have no idea what it feels like. In the early 80s, i went to a Rolling Stones concert in a huge stadium in Los Angeles. It had festival seating which means sit where you want. We sat in the field next to thousands of others where many were smoking weed. I think it make me a little dizzy but i don't know if it was just from the smoke or the effects of it. I don't remember thinking i felt off or drugged.. My point is that, if i didn't get a contact high from so many people smoking at once, i don't think it contacts high actually happen. Having said that, i am sure my clothes would have come up positive in a drug test. As for the concert, i think we got there at 730 am, they had many many opening acts with the Stones coming out around 530 or so. I think we watched the Stones for maybe an hour because i was so tired from being there 10 hours and left. It was kind of historic because Prince was one of the opening acts. He was actually booed with the concert promoters coming out and telling everyone to behave. The wrong crowd for Prince. I had never heard of him at that time. J Geils Band played as well as Geroge Thorogood and the Destroyers. Two other bands that I liked but i had never heard of at the time.
81 or 82 at The Coliseum. I grew up 10 miles away and was a HS freshman. Prince getting booed off the stage was all people talked about at school. J Geils was popular due to Centerfold. Always wondered why our hometown boys VH opened for them in Florida but not L.A.

I dont think Centerfold had come out yet because it was a huge hit when it came out so i would have known who the band was.. It's been so long so i dont remember, but i dont think I knew who J Geils band was at that point. According to Google, the song came out in Sept 1981 and the concert was in Oct. 1981. Honestly, Prince wasn't good and I didn't who he was or his songs and it was the wrong crowd. He was singing a song called Jack U Off, which i have never since heard played. Honestly, i am surprised your school would have talked about Prince. It was way before Purple Rain but then again high schools may have been more intuned with his music. In 1981, I was in college and was listening to New Wave and Punk Music.
 
My public school was integrated with the prevailing majority being African American..this was the height of the Disco Sucks era, which ran across racial lines mostly, and Van Halen were the local boys made good having grown up just down the street from this school, while KROQ was a new radio station introducing everyone to New Wave. There were still 3 rock stations in L.A. then. Rapper's Delight had just come out but rap was not a thing yet. L.A. metal scene was just about to explode with Motley Crue and Ratt. What a time to be in high school!

I was listening to KROQ and Prince wasn't being played in 1981. What i missed but my best friend in college went to prior to college was Madam Wongs whose restaurant had groups like Oingo Boingo, X, and the Go-Gos play there. Would have loved to see these groups in a small setting. Actually never heard of it until he took me there once. By that time, all of these groups had gone big and mainstream and playing stadiums. Sort of the West Coast version of CBGB

I was too young for MWs. Another venue was Perkins Palace in Pasadena where the punk bands played - Fear/Dead Kennedys/Black Flag etc. So at the same time you had new wave, punk and metal all incubating in L.A. A golden age musically, directly following the Laurel Canyon 70s CSN/Jackson Browne/Eagles etc that followed the Doors. We had it good in SoCal for a long time musically speaking.
