Not sure that this says what LITS said, but in BSA vs Dale, Supreme Court basically did a "carve out" for the Boys Scouts to exclude Homosexuals from participating. Not sure if today's court would still maintain the exclusion.

Looking at it as a military officer evaluating a program for its "leadership potential" element, its better for incoming Cadets and Mids to have been in a junior leadership organization (such as the BSA/GSA) that exposes them to other lifestyles. It would prepare them to be leaders in a diverse military. I am glad that the BSA has changed part of their policy.

Reading through the opinions in Dale makes a strong case for both sides though, and I am glad I am not a judge.

And they're changing it based on pressure from the public at large, not due to a court mandate. So the so-called "core value" that government can't force a private organization to be equally inclusive remains unsullied by this move.
