Cal Poly AROTC PMS Arrest (Innocent until proven guilty - but does not look good)

I don’t know how military justice works.

If he is found guilty, wouldn’t he then be court martialed?
Double jeopardy applies. The military typically will not duplicate those charges. If someone else has jurisdiction, the military waits until it is done, and then has a variety of options. Civilian authorities can also hand over jurisdiction to military. Unlike what you see on NCIS, military usually has jurisdiction on military-on-military crime onboard a military installation. Off-base, it’s civilian jurisdiction, though if military-on-military, it will often be handed over to the military.

If a court-martial is scheduled, then the military equivalent of a grand jury proceeding has likely occurred. There would be the expected charges (if not already addressed in civilian proceedings), but also quite possibly the military-unique “conduct unbecoming” and a few others that can be liberally applied. There are also administrative options that can be used. The Navy has officer boards of inquiry, not sure what other services call it. In a court-martial, rules of evidence apply. It can be with/without jury of officers. Here’s some reading:

Excuse me stewardess, I speak Jive (I think I can help decipher some of this - here goes - pure speculation on my part but let's see - feel welcome to skip reading this post.

Aha - new account - only these 2 posts. It appears this was written by someone who may be connected to or actually be the accused - someone so close to this who is deeply upset and impacted- dare I say unhinged- so emotional it's hard to follow the bouncing ball. This poster is taking a few steps to attempt to protect the accused by attacking anyone who, say, shared an article about this, or is the one prosecuting, or reporting on it, etc. I find it both sad, and I have empathy that someone who take such desperate steps to, like a magician, redirect focus here to attack others to refocus against some very serious charges.

The playbook is simple:
First, Ad Hominem attacks - attack and eviscerate anyone who implies the accused is guilty. even anonymous internet posters are careless, anyone who is trying this is a liar, anyone reporting on this is careless, lying, etc. Smear them as careless, racist, corrupt - the whole lot of them, or I guess in this case, us.
Denial- not just a river in Egypt. Challenge any statement that doesn't look good as completely false untruths. Challenge anyone who states anything damning as unfair, inaccurate, untrue, careless.
Repeat innocent until proven guilty to the people who said that (me) initially (see my original post title) as if it's new or news.
Lather, rinse, repeat.

I've seen this before - years ago a 35 year old youth pastor slept with one of the teens in his congregation - a15 year old kid His Daddy was the full pastor, he was just somehow put in charge of kids. -he was in a supervisory position over that child. She told her 15 year old friends about her adventures, bragged she thought he would leave his wife for her, her friends told the school, who called the police and a criminal trial ensued. Someone close to that man or that man too himself got online, rebutted posts with comments like innocent until proven guilty, and quoted bible verses, and like here talked about whether this was even the full criminal matter or should be in a different venue (there they argued civil vs criminal, here I see an argument for diversion - which by the way, the accused requested and that was denied. It's the same playbook but in the end the facts are what they are- my posting an article doesn't mean the article is correct, or wrong, or that this person did or did not do what they are accused of.

It must be difficult to fall this far, and if there's one thing we agree on, it's the hope the accused will get help if he needs it. I also hope they can help the victims as they are notified if the accusations are true. Constructively, attacking anyone who points out a ROTC leader was arrested and trying this case in anonymous internet boards? Again, sounds desperate, from someone in crisis. OP, read your posts - you sound hysterical - not the good Rodney Dangerfield kind -the spiraling / not-cohesive kind - I think you have a point to make but you're so wound up and lashing out that you're not appearing to make much sense - please sober up or if you are sober, get some sleep, and try to make your point again in the morning if you'd like. Good luck to you, good luck to the victims if proven there were any, and when the UCMJ adjudicates this, please follow-up to let us know how you/they/he/we - whatever pronouns you would like to use here fair. The good news for you is that if the accused is innocent he will retain his military pension, likely have a huge settlement coming his way. I don't agree everyone accusing or discussing is wrong and that there is no foundation, but my opinion matters not -I'm not on the court martial jury - let's see what happens at the court martial.

OK, @Dark Shadow/ISA you said your peace. I've offered food for thought that may help you understand how you appear (at least to me) - compose yourself and let us know what else is on your mind.

After pleading guilty to Articles 120c and 133, he was sentenced by a military judge with a REPRIMAND. He is allowed to keep his pay, rank, and retire under honorable conditions.

The charges he pleaded guilty to would landed him in PRISON if prosecuted on the civilian sector. IMO, this is bullsh*t.

And people wonder why AD women question if there’s justice in military responses to acts against women. I’d bet there’d be a different outcome if he’d been looking at young boys. Or if he was an O1 or enlisted

Does this sentencing place him on the offender registry?
 
I don’t see this outcome as penalty free – while the lack of a punishment was offensive, he was still guilty of 2 UCMJ offenses. His reputation is still destroyed. He’ll never again pass an FBI background check for any position to work with children, or be a coach/ scouting leader, or be eligible for most volunteer groups, etc. Any future employer will google him, see this exact page and other articles, and find a reason to say no thank you, even if they will not admit it formally. The two scout leaders in my town who were also caught with kiddie porn like the Sweathog are ostracized, each divorced, and each work the midnight shift at Wawa – one was a pharmacist, the other a chemist at a big pharma– literally the only job either could get at a 90+% pay reduction from what they were doing. He’ll have his pension, and be generally unemployable. His kids will wonder why no one comes to their sleepovers or parties. or home from college visits like they used to. His family will wonder why they are no longer on the list for social gatherings. Even his friends who stick with him will need to do an electronics sweep after he leaves, ultimately they too will shut him out. If he sinks savings into some business and hangs a shingle/ he’ll wonder why contracts drop off and it fails. I mean the Army has him stashed away from people linking paperclips together in a sub-basement. OJ, Robert Blake, Jacob Sweatland – they got away with it, but they didn’t really get away with it – he’ll be under a cloud of suspicion, quoth the raven, evermore. A pariah, for-eva.

It’s civilian jurisdiction, so whatever CA does, the Army cannot duplicate due to double jeopardy. But - the blessed UCMJ provides the ever handy “brings discredit to the service,” “conduct unbecoming” and possibly “good order and discipline,” which can all stretch nicely cover the entire thing. Then some type of adjudication, possibly a court-martial, or more likely a board of officer inquiry for officer misconduct and separation.

I have seen some nasty cases like this, and these folks need to be booted out. Off with his head.
You can be tried in a civilian court and under UCMJ for the same offense. Plus tack on "administrative" actions and you can get nailed several times for one offense.
