I would think if the MOC didn’t have an available slot then he shouldn’t nominate anyone and they would let the MOC knowNo -- each Congressman can have up to 5 Midshipman in a Service Academy at one time. Theoretically, they could probably have all 5 in the same year , and not have an available slots for the next 4 years. I would expect this scenario is very unlikely -- most MOC spread it out , and usually have 1 or 2 openings in any given year. Also, as MidCake points out, they also need to be qualified and accepted.
My DS was already denied but I was asking because he didn’t get a nomination from our congressman because he received one from our Senator and they said once you get a nomination please let the senator know so he will give someone else that nomination that we look back I hope that it wasn’t the case that he didn’t have any openings on his slateIt's one of those things you have no control over so I wouldn't worry about it. Concentrate on putting your best application together. Good Luck!

I've been briefed by admissions that the five "slots" are spaced out so that there are no "zero" years.
