As retired LE I continue to be amazed at the way routine-looking state crimes, i.e. those w/minimum sentences, catch & release, no bail required, can be taken to our friends in federal court!!
Robbing a pharmacy (Hobb's Act?? WTF??)...burning a patrol car...tisk-tisk, for shame...

To those active LE, (& firearm owners) out there, suggest you subscribe to the ATF's website, lots of knowledge over there...you know, for that special perpetrator...The one who needs to constantly be reminded (for the next 5-10) that, "If you can't do the time, don't do the crime!!"

Wonder how that law was debated in Congress?

Ok, I get it, you're thinking I'm always taking the LE side...What about if someone wants to know how to be one?? For the aspiring offender, here it is' ($9 used)! State time is for wussies! Make Mom & Dad proud!

I rely on the Castle Doctrine.. If they end up outside I drag them through the window and hope CSI doesn't notice the drag marks down the driveway.

Interesting .. I think the LE community is learning this lesson where in those communities where the state prosecutors are releasing criminals on a catch and release basis. I hear the shock effect of dropping a repeat miscreant into the federal system gets their attention, fast !

"Happy wife, happy life!" Advice those engaged in criminal enterprises with federal jurisdiction would be wise to follow. For your consideration:


36 y/o perp with 4 felony priors looking at federal time for mere possession of ammo. Being convicted of a felony in NYS is hard. These cases are usually plea-bargained down to misdemeanors thereby ensuring a high % conviction rate for the local DA. It all went south when the cops were called in on a domestic disturbance. Max penalty is 10 years & 250K fine. With this being his 5th felony conviction...looks like he might be doing a "dime."

Here a perp is charged with possession with intent to distribute marijuana, and possession of a firearm in furtherance of drug trafficking. Max penalty is life in prison & 1M fine. Marijuana is still a Schedule 1 Drug Offense. Again the perp's undoing began with a domestic disturbance call to PD.

So glad to see NYS LE taking more & more cases federal as the current state court system is a joke. The perp is not the victim. The victim is the victim; esp. when firearms are illegally possessed.
